Terms of Service

1. The agreement
These terms are between you and [LEGAL ENTITY, 🔶 TODO: confirm] ("PuckSurveys", "we", "us"). By using PuckSurveys, whether you're answering a survey or building one, you agree to them. If you don't agree, please don't use the service.
2. Who can use it
You need to be old enough to form a binding contract where you live (and at least 16). If you use PuckSurveys for an organization, you confirm you're allowed to accept these terms for it.
3. Accounts
- Creating surveys requires an account; answering them doesn't.
- We sign you in with a one-time link sent to your email, keep access to that inbox secure, since whoever controls it can access the account.
- You're responsible for what happens under your account.
4. What you can and can't do
You agree not to use PuckSurveys to:
- break the law, or collect data illegally;
- run surveys designed to harass, deceive, defraud, or harm people;
- collect sensitive personal information you have no lawful basis to collect (e.g. harvesting government IDs, financial account numbers, or health data without proper consent and grounds);
- send spam, or drive automated/fake responses to manipulate results or our analytics;
- probe, scrape, overload, or attempt to break the service or its security;
- remove or obscure the "Powered by PuckSurveys" badge except where a paid plan grants that.
We can suspend or remove surveys or accounts that break these rules.
5. Your content and data
- You own what you make. Your surveys and the responses you collect are yours.
- You grant us the limited license needed to host, process, back up, and display that content so the service can function, nothing more. We don't sell it or use it for advertising (see the Privacy Policy).
- You're the controller of your respondents' data. If you collect personal data through a survey, you're responsible for having a lawful basis, telling respondents what you're doing, and honoring their requests. We're your processor for that data.
- You can export your data and ask us to delete it (Privacy Policy covers how).
6. Plans, limits, and payment
- PuckSurveys is currently free, with no fixed response allowance. We may introduce limits or paid plans as the product evolves; we'll aim to give clear notice of meaningful changes before they take effect.
- We never delete responses over limits. There is no response cap today. If we ever introduce limits, responses beyond them will be stored safely and never silently discarded, and we won't charge surprise per-response fees.
- Paid plans (e.g. Pro) and billing terms will be described at checkout when they launch. Until then, any "reserve launch pricing" sign-up is just an expression of interest, it isn't a charge or a contract to buy.
7. The "snapshot" surveys are not assessments
Some of our surveys (personality, sleep, stress, and similar) give you a general, descriptive write-up and suggestions built from public-domain or original items. They are not medical, psychological, or diagnostic advice, and they are not a clinical assessment or a substitute for a professional. If something in your health or wellbeing concerns you, talk to a qualified professional. You use these results at your own discretion.
8. Service "as is" (it's early)
PuckSurveys is offered as is and as available. We're building fast and things can change, break, or go down. To the fullest extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, and we don't promise the service will be uninterrupted or error-free.
9. Limitation of liability
To the fullest extent the law allows, PuckSurveys isn't liable for indirect, incidental, or consequential damages, or for lost data or profits, arising from your use of the service. Where liability can't be excluded, it's limited to the amount you paid us in the 12 months before the claim (which, on the free plan, is zero).
10. Suspension and termination
You can stop using PuckSurveys anytime and ask us to close your account. We can suspend or end access if you break these terms or put the service or its users at risk. On account closure, we delete your data per the Privacy Policy's retention rules.
11. Changes to these terms
We may update these terms; we'll change the date above and, for account holders, flag material changes at sign-in. Continued use after a change means you accept it.
12. Governing law
These terms are governed by the laws of [JURISDICTION, 🔶 TODO: confirm, e.g. Nova Scotia, Canada], and disputes go to the courts there, except where local consumer law gives you stronger rights.
